PlayKovo Partner Terms

By registering a website, copying an embed code, using the feeds or opening the partner dashboard, you agree to these Partner Terms (the “Terms”) on behalf of yourself and any company or organization you represent. If you do not agree, do not use the catalog.

These Terms are in addition to the PlayKovo Terms of Use and Privacy Policy. If they conflict on a partner matter, these Terms apply.

You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding agreement.

• PlayKovo, “we” and “us” means the operator of playkovo.com and its related services.
• Partner, “you” means the person or organization that registers a website or uses the catalog.
• Catalog means the games PlayKovo makes available for embedding, shown on catalog.playkovo.com and in the JSON and XML feeds.
• Game means any game in the Catalog, including its code, artwork, sound, text, name and other materials.
• Embed means the iframe code or embed address (/embed/<game>) we provide for a Game.
• Feed Data means the titles, descriptions, images, categories and other metadata we provide about Games.
• Licensor means the owner of rights in a Game: PlayKovo, a developer who publishes through PlayKovo, or a third party such as an open-source author.
• Your Site means each website or app where you place Embeds or Feed Data.

Browsing the Catalog and copying Embeds does not require an account. A partner account and a registered website are needed to see statistics in the partner dashboard.

• The information you give us (name, contact email, website address) must be true, complete and kept up to date.
• You may register only websites that you own or are authorized to operate.
• You are responsible for everything that happens under your account and for keeping your login secure.
• Websites are registered automatically. That is not a review, approval or endorsement of your site or its content by PlayKovo, and it does not limit our right to act under these Terms.

Subject to these Terms, PlayKovo grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• display Games on Your Site by using the Embed exactly as we provide it, so that the Game runs from PlayKovo servers; and
• use Feed Data, including thumbnails and cover images, only to list, promote and link to Games that you embed or intend to embed.

This license covers only what is written here. You receive no rights in the source code, game files, artwork, sound, trademarks or any other part of a Game. All rights not expressly granted are reserved by PlayKovo and the Licensors.

The Catalog is free of charge. We may change, limit or end access to it at any time.

Every Game is owned by PlayKovo or by a Licensor. Embedding a Game never transfers ownership, authorship or any rights to you.

You agree that you will not:

• present, describe, market or label any Game as your own creation, your company's creation, or as developed, designed or produced by you or Your Site, in text, images, metadata, app store listings, press material or in any other way;
• place your own copyright notice, author credit, studio name or logo on, over or around a Game so that it appears to be the owner or creator;
• remove, cover, crop, hide or alter any PlayKovo branding, developer credit, license notice or attribution that appears in or with a Game;
• list a Game under your own name in another portal, marketplace, app store, contest, portfolio or catalog, or submit it anywhere as your work;
• state or suggest that you have a special or exclusive relationship with the developer or with PlayKovo that you do not have.

What you may say: you may truthfully describe Games as “games from PlayKovo”, “powered by PlayKovo”, or “playable free on our site through PlayKovo”, and you may name the developer where the Catalog shows one. You may of course describe Your Site as your own.

Credit, developer and license details for each Game are available on its page on PlayKovo, and for open-source games at playkovo.com/licenses/<game>. If you are unsure whether a statement is accurate, ask us before you publish it.

Some Games in the Catalog are made by PlayKovo. Some are made by developers who publish through PlayKovo and keep ownership of their work. Some are open-source games released under licenses such as the MIT license, and some are provided by third parties under their own terms.

You acknowledge and agree that:

• A Game being open-source, MIT-licensed or free does not make it yours, does not allow you to claim authorship, and does not allow you to remove the author's copyright and license notices. Open-source licenses require those notices to stay in place, and we keep them in place for you.
• Because you embed the Game from PlayKovo servers, you do not receive a copy of the Game's files from us. You may not download, extract, copy, mirror, host or redistribute the files, code or assets of any Game, even a Game whose license would allow it for someone who lawfully obtained the source elsewhere. If you want to use an open-source game's source code, get it from the original author and follow that license yourself.
• Third-party Games may be subject to additional terms of the Licensor. We may show or link those terms, and you agree to follow them.
• Developer-owned Games are made available to PlayKovo for distribution. The developer keeps ownership and can ask us to change or remove the Game at any time.

In addition to section 5, you may not:

• modify the Embed code in a way that changes, hides, blocks or replaces the Game, its ads, its branding, its credits or its controls, or that removes the allow permissions the Game needs;
• place buttons, overlays, invisible layers or other elements over a Game to capture clicks, or force, trick or reward visitors into launching a Game;
• generate launches or visits artificially, including bots, scripts, auto-play, purchased or incentivized traffic, or repeated self-launches, to influence statistics;
• copy or rehost Feed Data images or descriptions in a way that is not needed to list the Games you embed, or resell, sublicense or offer the Catalog or Feed Data to others as your own product or service;
• scrape the Catalog in a way that overloads our services. The Feed is cached for five minutes, so fetch it no more often than that;
• reverse engineer, decompile or attempt to access the source code of any Game or of our services, or try to bypass technical protections, referrer checks or usage limits;
• use the Catalog on a site or app that contains or promotes illegal content, pirated material, malware, adult sexual content, hate speech, harassment, or content that exploits minors;
• use the referrer restriction (referrerpolicy="no-referrer") or other methods to hide your site from us, or register a website that you do not control;
• do anything that violates the law or the rights of others.

• You are responsible for Your Site, its content and how you place the Embed. Games are made for a general audience; if Your Site is directed at children, you are responsible for meeting the laws that apply to it.
• You must have a privacy policy and, where the law requires it, cookie and consent notices on Your Site for your own data collection.
• When a visitor plays a Game, PlayKovo may set cookies or use similar technology inside the Embed and process limited data, as described in the Privacy Policy. Where consent is required, we only record launch analytics after the visitor accepts cookies.
• Do not pass personal data about your visitors to us or place the Embed in a way that makes us collect it for you.

If you register a website, the partner dashboard shows launches and players from your registered domain. We identify your domain from the referrer of the page that contains the Embed.

• Statistics are estimates, not exact counts. Visitors who do not accept cookies are not counted, and a “player” is a browser, not a person.
• Statistics are provided for your information only. They are not a guarantee, an invoice or a basis for payment.
• We may use aggregated and de-identified data to operate, secure and improve the Catalog and our services.

• Games may show PlayKovo house promotions or third-party advertising. You may not block, hide, alter, replace or interfere with them.
• At the time of these Terms, the partner program does not include a revenue share or any payment to partners. Registering a website creates no right to payment.
• If we introduce revenue sharing or other paid features, they will be governed by separate written terms that you must accept first. Nothing in these Terms promises future payment.

We may add, change or remove any Game at any time and without notice, for example because a license ends, a developer withdraws a Game, a complaint is made, a Game fails our quality or safety checks, or for technical reasons. Embed addresses may stop working.

• If we ask you to remove a Game from Your Site, you must do so within three (3) business days, or sooner if we tell you there is a legal or safety reason.
• Review the Feed regularly and remove Games that no longer appear in it.
• If you believe a Game infringes your rights, use our copyright notice process. We handle valid notices and may remove the Game from the Catalog.

You may use the PlayKovo name and logo only to accurately show that a Game is provided by PlayKovo, for example “Powered by PlayKovo”, and only in the form we provide. You may not use them in a way that suggests we endorse, sponsor or are affiliated with you or Your Site, or as part of your own name, domain, app name or logo. We may ask you to stop using them at any time.

• You may stop using the Catalog and close your account at any time by removing all Embeds and contacting us.
• We may suspend or end your access, disable Embeds for your domain, or remove your website from the program at any time, with or without notice, especially if you breach section 5 or 7, if we receive a valid legal complaint, or if Your Site creates a risk for us or for players.
• When access ends, you must remove all Embeds and stop using Feed Data, images and PlayKovo branding within seven (7) days, and sooner if we tell you there is a legal reason.
• Sections that by their nature should continue, including 5, 6, 7, 14 and 15, survive termination.

The Catalog, Games, Feed Data and dashboard are provided “as is” and “as available”. To the fullest extent the law allows, we give no warranty of any kind, including that Games are error-free, always available, suitable for a particular purpose, or free of third-party claims, and we do not guarantee any traffic, engagement or income.

To the fullest extent the law allows, PlayKovo is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of these Terms or your use of the Catalog. Our total liability for any claim is limited to EUR 100, because the Catalog is free. Nothing in these Terms limits liability that cannot be limited by law.

You agree to defend and compensate PlayKovo and its Licensors against claims, losses and costs (including reasonable legal fees) that arise from Your Site, your content, or your breach of these Terms, including any claim that you presented a Game as your own or misused a Licensor's work.

• Changes. We may update these Terms. When we make a material change we will post the new version here with a new date and may also notify you by email or in the dashboard. If you keep using the Catalog after the change takes effect, you accept the new Terms.
• Entire agreement. These Terms, the Terms of Use and the Privacy Policy are the whole agreement between you and PlayKovo about the partner program. If a part is found unenforceable, the rest stays in force.
• No waiver. If we do not enforce a right immediately, we do not give it up.
• Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a business change.
• Governing law. These Terms are governed by the laws that apply at the place where the operator of PlayKovo is established, without regard to conflict-of-law rules, and the courts there have jurisdiction, except where mandatory consumer or other law gives you different rights.
